1. The Application
This Acceptable Use Policy (the “Policy”) governs the accepted and restricted use of the MaxGo Keyboard Toggle Application (the “Application”), provided by Handheld Group AB, a company incorporated in Sweden under company registration number 556556-2799 (“Handheld”). You (the “Authorised User”) are an individual user authorised to access the Application by a legal entity (the “End User”). The End User has been granted a licence to use the Application by entering into the End User Licence Agreement with Handheld (the “EULA”).
We may process certain personal data relating to Authorised Users using the Application. We shall process such personal data in compliance with applicable data protection legislation and in accordance with our privacy policies, available at Privacy Policy, Handheld Device Policy.
The Authorised User accepts to adhere to this Policy by accessing and using the Application.
2. Permitted use of the Application
The Authorised User may only use the Application after being authorised by the End User and it is only permitted for the Authorised User to use the Application for lawful purposes. The Authorised User agrees to comply with all applicable laws, rules, and regulations, including this Policy, in connection with its use of the Application and otherwise in connection with this Policy.
3. Prohibited use of the Application
The Authorised User is prohibited from using, or in any way facilitating or sup-porting others to use the Application:
(i) for any unlawful, fraudulent, infringing or offensive purposes;
(ii) for any activities that are illegal, that violate the rights of others, including intellectual property rights, or that may be harmful to others, Handheld’s operations or reputation, including engaging in a behaviour that appears threatening, stalking, defaming, defrauding, degrading, victimising, or intimidating for anyone for any reason;
(iii) to violate, or attempt to violate, the security or integrity of the Appli-cation or any other of Handheld’s network, electronic services, applications or other technical equipment and software. E.g., by transmitting damageable code or viruses through the Application;
(iv) to gain access to the Application in any fraudulent or unauthorised way, including bypassing or circumventing the Application’s access controls as well as accessing or authorising anyone to access the Application from an embargoed country;
(v) for attempting to reverse engineer, decompile or otherwise derive or attempt to discover source code, object code, trade secrets, know-how or algorithms of the Application as well as any portion thereof;
(vi) to remove, modify, or tamper with any regulatory or legal notice or link that is incorporated into the Application, including this Policy, or providing or creating links to external sites that violate this Policy or other legal agreements Handheld provide;
(vii) to scrape, replicate or copy the Application for any purposes that falls outside such use that is expressly permitted by this Policy or the EULA; or
(viii) to copy, frame, mirror or utilise any framing techniques to alter, re-move or enclose any part or content of the Application, including any trademarks or service marks contained therein.
You further represent and warrant that any information, content or other mate-rials, including that of third parties, that you upload, submit or otherwise make available to Handheld in the course of your use of the Application do not infringe any third party’s intellectual property rights, and do not constitute a breach, of any applicable legal and other regulatory requirements.
4. Miscellaneous
The Authorised User is solely responsible for protecting its device(s) against any interference, spyware or viruses that may be encountered when using the Application.
The Authorised User acknowledge that information provided or uploaded to the Application may be stored outside of the country in which the Authorised User reside.
Nothing in this Policy is intended to grant any rights, included but not limited to intellectual property rights, in or to the Application.
Failure to enforce this Policy in every instance does not amount to a waiver of Handhelds’ rights.
Except as expressly stated in this Policy, the Application is provided on an “as is” and “as available” basis without any warranties of any kind. Handheld expressly disclaim any and all warranties, whether express or implied, including implied warranties of merchantability, title, fitness for particular purpose, and non-infringement.
This Policy and any non-contractual obligations arising out of or in connection with it shall be governed by and construed in accordance with the laws of Sweden, excluding its conflict of laws principles providing for the application of the laws of any other jurisdiction.
5. Enforcement
Handheld reserves the right, to on its sole discretion and judgment, take any action Handheld deems necessary, if there is a suspected breach of this Policy. All suspected violations of this Policy shall be reported to Handheld via the e-mail address: privacy@handheldgroup.com.
If the Authorised User violates this Policy or authorise or help others to do so, Handheld may immediately terminate or suspend the Authorised User’s access to the Application, and Handheld may or may not provide a notice before taking action. Handheld may also remove, disable access to, or modify any content or resource that violate this Policy or any other agreement governing the use of the Application.
Handheld may cooperate with legal authorities or other appropriate third parties in connection with any investigation of suspected illegal conduct violating this Policy.
